UAE Notice Period Legislation & Buyout Rules

When terminating an employment contract in the UAE private sector, both employers and employees are legally obligated to serve written notice according to the agreed timeframe recorded in the MOHRE contract.

Core Statutory Provisions of Article 43

  • Duration Boundaries: The notice period must be between 30 and 90 calendar days. Contract clauses demanding over 90 days or zero notice are legally non-binding.
  • Continuous Full Salary: The employee performs contractual obligations and receives their full regular gross salary throughout the notice duration.
  • Job Search Absence Entitlement: If the employer initiates the termination, the employee is entitled to 1 unpaid day per week (or 8 hours per week) to attend interviews and seek employment, provided they give 3 days prior notice to the employer.

Pay in Lieu of Notice (Notice Buyout)

If either party terminates the employment relationship immediately without serving the full notice period, the terminating party must pay monetary compensation in lieu:
