UAE Overtime Legislation & Calculation Rules
In the UAE private sector, overtime compensation is governed by Article 19 of Federal Decree-Law No. 33 of 2021 on the Regulation of Labour Relations and Cabinet Resolution No. 1 of 2022. Employers must compensate eligible workers for time worked beyond normal daily working hours.
How the Statutory Hourly Rate Is Derived
Under MOHRE guidelines, standard monthly working hours are standardized as 240 hours (30 calendar days × 8 hours per day). Overtime calculations are based strictly on the employee's Basic Salary:
Overtime Rates & Statutory Premiums
| Overtime Scenario | Statutory Rate | Calculation Formula |
|---|---|---|
| Daytime Overtime (4:00 AM – 9:00 PM) | 125% (1.25×) | (Basic Salary ÷ 240) × 1.25 × Hours |
| Night Shift Overtime (9:00 PM – 4:00 AM) | 150% (1.50×) | (Basic Salary ÷ 240) × 1.50 × Hours |
| Weekly Rest Day / Off-Day Work | Substitute Day Off OR +50% | Full Basic Day Rate + 50% Wage Premium |
Maximum Legal Overtime Limits
Under Article 19(4), total overtime work may not exceed 2 hours per day, unless the work is necessary to prevent significant loss or serious industrial accident. Total combined working hours cannot exceed 144 hours across 3 consecutive weeks.
